San Gennaro Feast of the Hamptons FIAT Lease Raffle  The San Gennaro Feast of the Hamptons or (“SGFTH”), an New York State nonprofit corporation and 501(c)(3) public charity (EIN 46-0908136). In Accordance with all federal and state laws and rules, the SGFTH is holding a fundraising raffle (“Raffle”). Proceeds of the Raffle will benefit the San Gennaro Feast of the Hamptons and its mission.   Prize: The prize is available due to the generous donation of Brown’s Automotive Group of Patchogue and the SGFTH.The winner of the raffle (“Winner” as hereinafter defined) will win the option to engage in a twenty four (24) month, twenty four thousand 24,000 miles lease for a 2019 FIAT Spyder.   It shall be the sole responsibility of Brown’s Fiat of Patchogue to furnish the Prize to the Winner. The Winner agrees to assume and pay all taxes, fees and charges, including but not limited to license, title, and registration fees; insurance costs, as required by the terms of the lease agreement; Local, state and federal taxes, including taxes on gambling winnings, which must be paid prior to entering into the lease agreement; expenses related to the damage or loss to persons or property as a result of the lease not covered by insurance; costs incurred as a result of exceeding lease mileage at a rate not to exceed twenty five cents ($.25) per mile in excess of 24,000 miles; and any other costs or expenses related to the Prize.   SGFTH shall be responsible for notifying Brown’s Fiat of the identity of the Winner and providing pertinent contact information. SGFTH shall not be responsible for the ensuring the execution or delivery of the Prize. The Winner shall be reported to the Internal Revenue Service (IRS) pursuant to IRS Publication Numbers 1340 and 1335 by filing a Form W-2G, Statement for Recipients of Certain Gambling Winnings. A copy of any W-2G will be provided to the Winner. The Winner shall provide SGFTH with all the necessary information, including a completed copy of Form 5754, Statement of Person(s) Receiving Gambling percent (25%) of the fair market value of the lease or of the cash winnings, less the cost of the winning wager, prior to the Winner’s execution of the lease or receipt of the cash winnings. Winner agrees to accept the Prize “AS IS,” with no warranty guarantee, either express or implied by SGFTH, except as specifically provided by Brown’s Fiat of Patchogue or the vehicles manufacturer.   The Prize is not transferable. Winner must provide all necessary IRS documentation and tax payments and claim the Prize from Brown’s Fiat of Patchogue within thirty (30) business days from the date of the notice that he or she has won the Raffle. In the event that the Prize is not claimed within the specified time, no other Prize will be awarded or substituted.   Participation Eligibility: All residents of the United States who are 18 years old or older as of the date of the Raffle drawing, September 29 th , 2019 shall be eligible to participate and win the Prize, unless the individual was directly involved in the organization of the raffle or the sale or drawing of raffle tickets. San Gennaro Feast of the Hamptons Board Members and staff shall also be ineligible to win the Prize. All applicable federal, state and local laws and rules apply. Void where prohibited.   To Enter the Raffle: Tickets will be sold between August 1st, 2019 and September 29th, 2019 for a price of fifty dollars ($50) per ticket or 3 for $100. There is no limit to the number of tickets that a single person may purchase.   The odds of winning the Prize will depend on the final number of raffle tickets sold. Only eligible participants shall be permitted to enter the Raffle and any ineligible entries shall be disregarded, without cash refund, as if the Raffle entry was not made. Pursuant to IRS rules, amounts paid for Raffle tickets do not qualify as deductible charitable contributions.  

  Prize Drawing: The Raffle drawing will take place on September 29 th ,2019 at The San Gennaro Feast of the Hamptons, Good Ground Road Hampton Bays at approx. 6 p.m.at a public drawing. The name that appears on the first Raffle ticket selected from among all the entries to meet the requirements as set forth herein will win the Prize (“Winner”). In the event that multiple names appear on the Raffle ticket, the first name listed will be deemed the Winner. The purchaser of a ticket will not be deemed to be the Winner unless his or her name appears on the selected ticket. If the winning ticket contains incomplete information, or the ticket is otherwise deemed noncompliant with these rules as determined the discretion of SGFTH, the ticket will be deemed void.   One (1) successive alternate shall be drawn at the same time (“Alternate Winner”). In the event that the Winner does not claim the Prize or is deemed otherwise ineligible, the Prize will be awarded to the Alternate Winner, which shall provide all the necessary IRS documentation and tax payments and claim the Prize from Brown’s Fiat of Patchogue within thirty (30) business days from the date of the notice that he or she has won the Raffle. In the event that the Alternate Winner does not claim the Prize within the specified time, no other Prize will be awarded or substituted and no other winner will be selected.   General Terms and Conditions: By purchasing a Raffle ticket, all purchasers agree to be bound by all terms, rules, limitations and restrictions set forth herein and as required by federal, state, and local laws, rules, and regulations.   Pursuant to federal law, Winner shall be responsible for payment of tax on Winnings. The Winner assumes and must pay all applicable taxes, fees, and charges, including but not limited to, license, title, and registration fees, local, state, and federal taxes, and tax and/or legal obligations, including payment of taxes. Winner shall be responsible for consulting with his/her tax and/or legal adviser on all matters pertaining to the Prize.   By entering the Raffle, the Winner agrees that his or her likeness may be disclosed to and used by the SGFTH, Browns Automotive Group, and the local news media for promotional purposes without additional compensation. In addition, all participants, by entering the Raffle, agree to release SGFTH and Browns Automotive Group, its directors, officers, employees, agents and assigns from any and all liability for injuries, deaths, losses, and/or damages of any kind cause by or relating to participation in the Raffle or winning the Prize. The Winner and/or his or her family, heirs.   Associates, or assigns agree to indemnify and hold harmless SGFTH and Browns of Patchogue, it directors, officers, employees, agents, and assigns from any and all claims or actions of any kind arising in connection with or as a result of the Winner’s acceptance and/or use of the Prize.   All Raffle ticket sales are final. Raffle ticket purchasers acknowledge and agree that SGFTH has the right to elect not to proceed with the Raffle for any reason at its sole discretion, and in such event, A Raffle ticket purchaser’s exclusive remedy shall be to receive a refund of the full price paid by such participant for each Raffle ticket purchased, without interest.   Effective July 20 th ,2019 San Gennaro Feast of the Hamptons, Inc.
